8. Availability

The provider strives to maintain uninterrupted availability of the platform. There is no entitlement to constant availability. Maintenance work, technical disruptions, changes to AI models, or force majeure may lead to temporary restrictions.

The quality and availability of AI functions may vary, particularly when changes are made to the AI models or their providers.

9. Liability

9.1 Limitation of Liability

The provider is liable without limitation for damages arising from injury to life, body, or health based on an intentional or negligent breach of duty, as well as for other damages based on an intentional or grossly negligent breach of duty.

In cases of slight negligence, the provider is only liable for breach of essential contractual obligations (cardinal obligations). Liability in this case is limited to the foreseeable, contract-typical damage.

9.2 No Liability for AI-Generated Content

The provider assumes no guarantee for the accuracy, completeness, or timeliness of AI-generated content, recommendations, or analyses. AI systems may deliver incorrect or incomplete results. The user is obligated to critically review all AI-generated recommendations and seek medical advice in case of doubt.

9.3 No Liability for Third-Party Content

The provider is not liable for the accuracy, completeness, or timeliness of scientific sources and community reports cited in the knowledge base. Responsibility for original sources lies with their respective authors and publishers.

9.4 No Liability for Health Damages

The provider is not liable for health damages resulting from the application of information or AI-generated recommendations presented on the platform. The use of all information and recommendations is at the user's own risk.

10. Data Protection

The processing of personal data, including processing by AI systems, is carried out in accordance with our Privacy Policy. By using the platform, you confirm that you have taken note of the Privacy Policy.

11. Changes to Terms of Use

The provider reserves the right to change these Terms of Use at any time, particularly when introducing new AI functions or changing the AI models used. Registered users will be informed of significant changes by email. Continued use of the platform after changes take effect constitutes acceptance of the modified terms.

12. Termination

The provider may terminate the usage relationship with immediate effect and block access in case of violation of these Terms of Use. This applies in particular to misuse of AI functions.

13. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the registered office of the provider, provided the user is a merchant, legal entity under public law, or special public fund.

14. Severability Clause

If individual provisions of these Terms of Use are or become invalid, the validity of the remaining provisions remains unaffected.
